1. Introduction
PaperScorer ("PaperScorer," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), codified at 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement committed using our services (the "Services") that are reported to our designated DMCA agent identified below.
2. Designated DMCA Agent
Our designated agent for receiving notifications of claimed copyright infringement is:
- PaperScorer
- Attn: DMCA Agent
- Anaheim, California
- United States
- Email: dmca@paperscorer.com
3. Filing a DMCA Takedown Notice
If you believe that content available on or through our Services infringes your copyright, you may submit a written notification pursuant to 17 U.S.C. § 512(c)(3). Your notification must include the following:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL or other specific location on the Services).
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
You may use the form above to submit a DMCA takedown notice, or you may send your notice directly to our designated DMCA agent at the contact information listed in Section 2.
4. Counter-Notification Procedures
If you believe that material you posted on our Services was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us pursuant to 17 U.S.C. § 512(g). Your counter-notification must include the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or if you are outside of the United States, for any judicial district in which PaperScorer may be found), and that you will accept service of process from the person who provided notification of the alleged infringement.
If we receive a valid counter-notification, we will forward it to the party who submitted the original DMCA notification. The original party will then have ten (10) business days to notify us that they have filed a court action to restrain the allegedly infringing activity. If we do not receive such notice within that time, we may restore the removed material or cease disabling access to it.
5. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, PaperScorer has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Services and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
6. Misrepresentation Warning
Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. If you are unsure whether the material you are reporting is in fact infringing, you may wish to contact an attorney before filing a notification with us.
7. Modifications to This Policy
PaperScorer reserves the right to modify this DMCA Policy at any time. Any changes will be effective immediately upon posting of the updated policy. We will update the "Last Updated" date at the top of this page to reflect the date of the most recent changes. Your continued use of our Services after the posting of changes constitutes your acceptance of such changes.
