Monitoring

The Site owner reserves the right but does not assume the obligation to review any content, text, images, files, information or other materials submitted to the Site by you. The Site owner reserves the right to accept, reject, modify and/or remove any such submitted material, in its sole discretion, at any time and from time to time, without notice. The Site owner is under no obligation to display any submitted materials. Account Termination

  • You may request export of your data before account deletion
  • We will delete your personal data in accordance with our Privacy Policy and data retention schedule
  • Some information may be retained as required by law or for legitimate business purposes

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any aspect of the Service at any time. Scheduled maintenance will be announced in advance when possible. We are not liable for any modification, suspension, or discontinuation of the Service.

Educational Institution Terms

For schools, districts, and other educational institutions:

  • You represent that you have authority to bind your institution to these Terms
  • You are responsible for ensuring compliance with FERPA, COPPA, and applicable state student privacy laws
  • You agree to obtain necessary parental consents for student users under 13
  • We will enter into Data Processing Agreements (DPAs) upon request
  • We support the Student Data Privacy Consortium (SDPC) National Data Privacy Agreement
  • Purchase orders may be accepted for institutional accounts

Dispute Resolution

Any controversy, dispute or claim arising out of or related to your use of this Site shall be resolved by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The exclusive venue for such arbitration proceedings shall be Orange County, California.

CLASS ACTION WAIVER: YOU AND PAPERSCORER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Nothing in the foregoing shall prevent the Site owner from petitioning a court of law for temporary and/or permanent injunctive relief in connection with any alleged or actual infringement, misappropriation or violation of any intellectual property rights of the Site owner.

Indemnification

You agree to indemnify and hold harmless the Site owner and its officers, directors, employees, agents, independent contractors and affiliates from all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these Terms and Conditions or any use of this Site, including, but not limited to, the use of or reliance on the Site by any person or the publication, transmission, distribution or other use of any content, text, images, files, information or other materials submitted to the Site by you. Enforcement

The exclusive venue for all litigation, court proceedings, arbitration proceedings and other proceedings in connection with these Terms and Conditions, whether in connection with arbitration or otherwise, shall be Orange County, California. All disputes in connection with these Terms and Conditions shall be governed by the laws of the State of California, without reference to that state's conflict of laws principles.

Force Majeure

Neither party shall be liable for any failure or delay in performing their obligations under these Terms where such failure or delay results from circumstances beyond the reasonable control of that party, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, pandemic or epidemic, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce, trade and economic sanctions maintained by the Treasury Department's Office of Foreign Assets Control, and the International Traffic in Arms Regulations maintained by the Department of State. You represent and warrant that you are not located in, under the control of, or a national or resident of any country to which the United States has embargoed goods or services.

Limitation of Liability

NEITHER SITE OWNER NOR ITS SUPPLIERS WILL BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER, EVEN IF SITE OWNER HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER IN AN ACTION UNDER CONTRACT, NEGLIGENCE, OR ANY OTHER THEORY, ARISING OUT OF OR IN CONNECTION WITH THE USE, INABILITY TO USE, OR PERFORMANCE OF THE INFORMATION, SERVICES, PRODUCTS, AND MATERIALS AVAILABLE FROM THIS SITE. THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. BECAUSE SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, OR THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THIS SITE OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Unless otherwise specified, this Site is for your personal and non-commercial use. Severability

General

No agency, partnership, joint venture, or employment is created as a result of this agreement or your use of this Site and you do not have any authority of any kind to bind the Site owner in any respect whatsoever. This agreement constitutes the entire agreement between you and the Site owner with respect to the subject matter herein. This agreement supersedes all prior or contemporaneous oral and written communications with respect to such subject matter.
